New Creation Labs LLC (“Company,” “we,” “us,” or “our”) operates the Mixtape mobile application and usemxtape.com (collectively, the “Service”). This Privacy Policy explains how we collect, use, disclose, and protect information when you use the Service.
By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the Service.
1. Information we collect
Information you provide
- Account information: When you sign in with Apple or Google, we receive an account identifier. If you choose to share it, we may receive your name and email address from your identity provider.
- Profile information: Username (handle) and optional display name you select.
- Social connections: Friend relationships you create within the app.
- Mixtape content: Songs you send or receive, optional notes, reactions, and related metadata (track title, artist, album art URLs).
- Communications: Information you send when contacting us for support.
Information collected automatically
- Device information: Device type, operating system version, and app version.
- Push notification tokens: If you enable notifications, we store a device token to deliver alerts about new mixtapes.
- Usage data: Basic logs needed to operate, secure, and improve the Service (e.g., error reports, authentication events).
Information we do not collect
We do not require access to your Spotify account to use Mixtape. Song search uses publicly available metadata via the Spotify Web API. We do not intentionally collect precise location data, contacts from your address book, or payment information through the current version of the Service.
2. How we use information
We use information to:
- Create and manage your account
- Authenticate you and maintain session security
- Enable you to send and receive mixtapes and update your home screen widget
- Deliver optional push notifications
- Enforce our Terms of Use and protect users
- Monitor, maintain, and improve the Service
- Comply with legal obligations
3. How we share information
We do not sell your personal information. We may share information in these circumstances:
- With other users: Your username, display name, mixtapes you send, and reactions may be visible to friends you connect with on the Service.
- Service providers: We use trusted vendors who process data on our behalf, including Supabase (hosting and authentication), Apple and Google (sign-in), and Spotify (song search metadata). These providers are authorized to use information only as needed to provide services to us.
- Legal requirements: We may disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, safety, and security of the Company, our users, or others.
- Business transfers: If we are involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction, subject to this Privacy Policy.
4. Data retention
We retain information for as long as your account is active or as needed to provide the Service. We may retain certain information as required by law or for legitimate business purposes (such as resolving disputes or enforcing agreements). You may request account deletion by contacting us; we will delete or anonymize personal information within a reasonable period, except where retention is required by law.
5. Your choices and rights
- Account deletion: Email hello@usemxtape.com to request deletion of your account and associated data.
- Push notifications: You can disable notifications in your device settings at any time.
- Sign-in providers: You can revoke Mixtape’s access through your Apple ID or Google account settings.
Depending on where you live, you may have additional rights to access, correct, delete, or port your personal information. California residents may have rights under the CCPA/CPRA. Contact us to exercise applicable rights.
6. Security
We use reasonable administrative, technical, and organizational measures designed to protect information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Children’s privacy
The Service is not intended for children under 13 (or the minimum age required in your jurisdiction). We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will take steps to delete it.
8. International users
The Service is operated from the United States. If you access the Service from outside the United States, you understand that information may be processed and stored in the United States and other countries where our service providers operate.
9. Third-party links and services
The Service may reference or display content from third parties (such as album art or links to streaming services). Third-party services have their own privacy policies, and we are not responsible for their practices.
10. Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated version on usemxtape.com and update the “Last updated” date. Material changes may be communicated through the app or by other reasonable means. Continued use after changes become effective constitutes acceptance of the updated policy.
